Users requesting a service for purposes unrelated to their professional activity have the right to withdraw from the purchase contract entered into with shoponlineitaly.com™ or with the Partner without any penalty and without having to provide any reason, within 14 working days pursuant to art. 52 paragraph 1 of the Consumer Code, which start from the day the product purchased on Shoponlineitaly.com™ is received.™. Withdrawal may be exercised by the Customer, pursuant to Art. 54 paragraph 1 of the Consumer Code, by submitting any explicit declaration of their decision to withdraw from the contract, to be sent either by return letter to FUORO 51 SRLS di Luigi Stinga, VAT No. IT08295681210, with registered office in Sorrento (NA) 80067, Via Fuoro 51 or by email to info@shoponlineitaly.com or, in the case of an intermediate sale, to the email address of the  Partner indicated in the purchase confirmation page and also present in the User Account, while also  making shoponlineitaly.com™ fully aware.  

The letter with return receipt, e-mail or fax must contain the product and order number. The burden of proof concerning the correct exercise of the right of withdrawal, in accordance with the above mentioned procedure, shall be borne by the User. Following the proper exercise of the right of withdrawal, unless shoponlineitaly.com™ or Partner withdraws the goods directly, the user shall be obliged to return the goods without undue delay and in any case within 14 days from the date on which the user has informed shoponlineitaly.com™ or Partner of their decision to withdraw from the contract pursuant to article 54, c. 4.  

The User shall affix, on the packaging, in a visible manner the document received from shoponlineitaly.com™ following the notice of withdrawal referred to above, in which the shipping address and the order details necessary to identify the return at destination are already indicated. The User is advised to place a copy of this document inside the packaging as well, in order to avoid its  loss or the impossibility of identifying the return once it reaches the warehouse. The relevant shipping costs of the goods shall be borne by the User, unless shoponlineitaly.com™ has not informed the same in this respect upon conclusion of the contract, in accordance with art. 57 paragraph 1 of the  Consumer Code.  

The goods must in any case be stored, handled and inspected with normal diligence and returned intact, complete in all their parts, accompanied by all accessories and illustrative sheets, identification tags and original labels, where present, still attached to the goods, undamaged and not tampered with, as  well as perfectly fit for their intended use and free of signs of wear or dirt. As stipulated in Art. 57  para. 2 of the Consumer Code, the User is liable for any decrease in value resulting from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the  goods. In this case shoponlineitaly.com™, subject to prior written notice to be sent to the User within 5 working days from receipt of the goods, may reduce the amount of the refund due to such decrease in value, providing the User, in case the refund has already been paid, with the bank details for the payment of the amount to be paid by the User as a result of the decrease in value of the goods. Shoponlineitaly.com™ may refuse to accept a withdrawal for food products that have been consumed  even partially. Pursuant to Article 59 of the aforementioned Consumer Code, goods that are made to measure or customized or which, by their nature, cannot be returned or are subject to rapid alteration  or deterioration are excluded from the possibility of withdrawal. 

Exceptions to the Right of Withdrawal  

It is in any case understood that, with reference to the provision of services, the right of withdrawal may not be exercised by the User after the products have been fully supplied by shoponlineitaly.com™ if the supply itself has started with the express agreement of the User and the latter has accepted  to lose the right of withdrawal following the full performance of the service by shoponlineitaly.com™. In any case, pursuant to Article 59 of the Consumer Code, goods that are made to measure or customised or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration are excluded from the possibility of withdrawal.

Refunds  

Any reimbursement by shoponlineitaly.com™, if due, shall take place pursuant to art. 56 paragraph 1 of the Consumer Code in the shortest possible time, and in any event not later than 14 days from the date on which the event giving rise to the refund occurred and, in case of withdrawal, from the day on which it became known to the User. shoponlineitaly.com™ will carry  out the refund using the same means of payment used by the User for the initial transaction, unless  otherwise agreed with the User and provided that the User does not incur any cost as a consequence of using the different means of payment. If the User has expressly opted for a different type of  delivery that involves higher delivery costs than the standard delivery offered by shoponlinetaly.com™ ("Additional Costs"), shoponlinetaly.com™ shall not be obliged to reimburse the relevant Additional  Costs. It is understood that, except in cases where shoponlineitaly.com™ has decided to collect the goods directly, shoponlineitaly.com™ may withhold the refund until they have received the goods or until the User has proved that they have sent back the goods, whichever situation occurs first.
